Notice of Rights of Victims

The following information is provided pursuant to RC 2930.06 et seq:

A criminal complaint as been filed against the above mentioned defendant.  The police reports indicate you may have been the victim of the crime.

Procedurally, a criminal prosecution begins with a complaint and is followed by the arraignment at which the defendant enters a plea.  If the defendant pleads guilty, the case will either be disposed of immediately or be set for a sentencing hearing.  If the defendant pleads not guilty, the case will be set for a trial.  The case may or may not involve a pre-trial conference, depending upon whether the defendant is represented by a lawyer.  If a felony is involved, the above procedures will be preceded by an initial appearance, a preliminary hearing and a grand jury indictment.  As the victim of the alleged offense, you will have the right to be present during all proceedings.

As the victim of a crime you have certain rights provided by law under the Ohio Crime Victim's Bill of Rights.  The following details some of the rights you are entitled to concerning your case.

You have the right to be contacted before a plea is accepted.

If you request to be notified of the status of the case, under O.R.C. 2919.25, 2930, and 3113.31, you have the right to:

know the time, date and place of any court proceeding concerning this case
place an objection to any lengthy continuance
be present when the defendant is in court
know of the conviction or acquittal of the defendant
make a statement to the court before sentencing of the defendant
have the court consider any such statement that is relevant
know if the defendant has appealed the conviction
know the sentence of the defendant and the possible release date
be present and make a statement at any subsequent judicial release hearing.

If the case is not settled with a negotiated plea, the matter may proceed to trial.  You are welcome to attend any proceeding.  If you are required to attend, the prosecutor assigned to the case will contact you by phone or issue you a subpoena.  If there are any special concerns you would like addressed during these proceedings, it is important that you bring them to the attention of the prosecutor assigned to the case.

You have the right to have a victim's representative exercise your victim's rights under Chapter 2930 of the Revised Code in accordance with section 2930.02.  If you wish the assignment of a representative, either contact this office or the Huron County Victim's Assistance Program at (419) 663-3839.

If you receive threats from the defendant or any other person, you should immediately call the police and inform this office.  Intimidation of a victim is a crime and will not be tolerated by this office and shall be investigated by the appropriate law enforcement agency.

If your address or telephone number changes at any time it is imperative that you notify this office as soon as possible.
